The conditions for using the websites, apps, and software we provide
These Terms of Service (these "Terms") set out the conditions for using the websites, applications, and distributed software provided by InformationCloset (registered business name: インフォメーションクローゼット; "we," "us," or "our"). These Terms consist of provisions common to all of the above (Part 1) and conditions specific to individual services (Part 2). By using any of them, you are deemed to have agreed to these Terms.

Part 1 — General Provisions
These Terms apply to the entire relationship between us and users concerning the use of the websites, applications, and distributed software we provide (together, the "Services"). Conditions specific to each service are set out in Part 2.
If you download (including install) any software or application we distribute or provide, you are deemed to have agreed, at that point, to these Terms and to our separately established Privacy Policy.
The Services include this website (infocloset.jp), our applications (such as MumoStream and NyXGridEncode), distributed software that you run on your own server (such as the ContactBox distribution edition and the MumoStream server), and the software licenses we sell. Where you obtain an app through a store such as the App Store, the conditions set by that store also apply. These Terms apply to any application or software we may newly provide or distribute in the future as well; where specific conditions are required, we will add a section to Part 2.
Intellectual property rights in the text, images, logos, designs, software, and other content included in the Services belong to us or to the rightful rights holders. Reproducing, reposting, modifying, or distributing them without the rights holder's permission is prohibited.
In using the Services, users must not engage in the following conduct.
The Services are provided "as is," and we do not warrant their fitness for a particular purpose, their completeness, or their freedom from error.
Except in cases of our willful misconduct or gross negligence, we are not liable for any damages incurred by users arising from the use of, or inability to use, the Services, or from the loss of data or the like.
Even where a link is provided from the Services to another website, or from another website to the Services, we are not responsible for the content of the linked site. When using a linked site, please review that site's terms of use.
We may change the content of the Services, or suspend or terminate their provision, without prior notice to users. We are not liable for any damages incurred by users as a result.
The handling of personal information arising from the use of the Services is governed by our separately established Privacy Policy.
The interpretation and application of these Terms are governed by the laws of Japan. Should a dispute arise between us and a user concerning the Services, the court having jurisdiction over our location shall be the exclusive agreed court of first instance.
Where we consider it necessary, we may change these Terms without prior notice to users. The revised Terms take effect from the time they are posted on this site.

Part 2 — Conditions by Service
This website is intended to introduce the applications and services we develop and to provide information about our activities. While we strive for the accuracy and usefulness of the information posted, we do not warrant its completeness or currency. The content of this site may be changed, added to, or removed without notice.
These are the conditions that apply when you send an inquiry, through the inquiry feature of an app we provide (such as MumoStream), to the inquiry management platform (ContactBox) that we operate.
We grant users a non-exclusive, non-transferable right to use the MumoStream client app and server software (the "Software") in accordance with these Terms. Except where permitted by law, users must not reverse-engineer, decompile, or modify the Software.
The client app is free to download, and certain features (Pro features) are unlocked through in-app purchase.
The server software is operated in an environment that the user provides. The setup, publication, security measures, data management, and backups of the server are all carried out at the user's own responsibility. The user warrants that they themselves hold the necessary rights to, or have obtained the rights holder's permission for, the content distributed, viewed, or stored through the Software. We are not involved in any way with the content the user handles, and we are not responsible for its content.
The unauthorized distribution or reproduction of works for which the rights holder's permission has not been obtained, unauthorized access to third-party servers or networks, and redistribution or resale beyond the scope of the license are prohibited. The Software is provided "as is," and except in cases of our willful misconduct or gross negligence, we are not liable for any damages arising from its use, the inability to use it, or the loss of data or the like.
We grant users a non-exclusive, non-transferable right to use NyXGridEncode in accordance with these Terms. NyXGridEncode is available as a free edition, which can be used without a license key, and as paid editions, whose feature limits are lifted by registering a license key. The features available in each edition, the number of jobs that can be processed at once, the number of devices that can take part in distributed encoding, and similar limits are shown on the product page. The purchase, refund, and revocation of licenses for the paid editions are governed by Section 17.
Except where permitted by law, users must not reverse-engineer, decompile, or modify NyXGridEncode, nor circumvent or disable its license verification or edition limits.
To use a paid edition, the device on which you register the license key must be able to connect to the internet. After registration, NyXGridEncode periodically connects to our license management server to verify that the license is valid; while it cannot connect, it continues to work for a limited period only. If verification cannot be completed within that period, the paid features become unavailable. There is a limit on the number of devices that can be registered; to use the software on further devices, you must deregister or replace a device you have already registered. The information sent for license verification is handled in accordance with our Privacy Policy.
The video files you convert with NyXGridEncode are provided by you. You warrant that you hold the necessary rights to, or have obtained the rights holder's permission for, the content you convert. We are not involved in any way with the content you convert, and we are not responsible for it.
By default, NyXGridEncode does not delete or overwrite your original video files. However, if you configure the folder-watching feature to move source files, send them to the Recycle Bin, or delete them, the software handles the source files according to that setting once conversion has completed. Backing up your source files and conversion results is your responsibility.
NyXGridEncode does not bundle the external tools it uses for conversion (FFmpeg, NVEncC, QSVEncC, VCEEncC, and libVLC). These are third-party software provided by their respective publishers; you obtain them from the publishers at your own discretion and use them under their respective license terms. We make no warranty as to, and accept no liability for, the operation, continued availability, or license terms of the external tools. The download sources and licenses of the external tools are listed on the Licenses page of the product site and in the documents included with the download.
Distributed encoding shares work across multiple devices that you provide, within a network that you manage. Securing the communication between devices (managing the authentication token, limiting the exposure of the listening port, and keeping the network safe) is your responsibility, and you must not use this feature on devices or networks that you do not manage. We are not responsible for the files and data exchanged between devices in connection with distributed encoding.
The system requirements for NyXGridEncode are shown on the product page. Conversion speed, quality, and the formats supported depend on the configuration of your device (including whether a GPU is present and which one, and the versions of the external tools) and on the content of the input files, and we make no warranty regarding them. NyXGridEncode is provided "as is," and except in cases of our willful misconduct or gross negligence, we are not liable for any damages arising from its use, the inability to use it, defects in conversion results, the loss of source files or conversion results, or the like.
These are the conditions that apply when you, as the operator, install and run software we distribute (such as the ContactBox distribution edition and the MumoStream server) on your own server. The conditions of this section apply in the same way to any software we may distribute in the future.
We grant the operator a non-exclusive, non-transferable right to install, operate, and use the distributed software in accordance with these Terms. Except where permitted by applicable law, the operator must not reverse-engineer the distributed software or redistribute or resell it beyond the scope of the license.
The distributed software is provided "as is." We make no warranty whatsoever as to its fitness for a particular purpose, its completeness, its freedom from error, or its continued provision, and except in cases of our willful misconduct or gross negligence, we are not liable for any damages incurred by the operator or its end users in connection with the use of the distributed software. Third-party software incorporated or used by the distributed software (such as FFmpeg) is subject to its respective license. The rights to the names and logos "ContactBox," "MumoStream," "NyXGridEncode," "InformationCloset," and "インフォメーションクローゼット," among others, belong to us, and these Terms do not grant any right to use these trademarks.
These are the conditions that apply to the software licenses we sell through this website or through the checkout pages we direct you to ("paid licenses"). They apply in the same way to any software we sell in the future. The information required under the Act on Specified Commercial Transactions of Japan is set out in our Notice under the Act on Specified Commercial Transactions.
A paid license unlocks the paid features of the software when its license key is registered in the software. We grant the purchaser a non-exclusive, non-transferable right to use the software under these Terms and the conditions shown on the product's page (such as the number of computers covered and the scope of features). Unless otherwise stated on the product's page, a paid license is a one-time purchase with no fixed term of use.
You pay the price shown on the checkout page (inclusive of Japanese consumption tax where applicable) when the checkout is completed. Payments are processed through Stripe, our payment service provider, and we do not receive card numbers or other payment details. For purchases from outside Japan, the displayed price may be converted into your local currency, and taxes imposed in your country or region may be added.
After payment is completed, we send the license key by email to the address you entered on the checkout page. If the license key does not arrive, please contact us at the address at the end of these Terms.
Because of the nature of the product, paid licenses cannot be returned or cancelled as a rule. However, if you request a refund within 14 days of the purchase date, we will refund the price regardless of the reason. Once a refund is made, the license is revoked and the paid features can no longer be used. In addition to the above, a payment may be reversed or refunded under the rules of the payment service provider or the card issuer.
We may revoke a license if the preceding section is violated, if a refund is made, or if the payment is reversed (charged back).
If, for reasons attributable to us, the software does not operate properly in the stated system requirements, we will provide a corrected version or refund the price. Our liability in such cases is limited to the amount of the price paid, except in cases of our willful misconduct or gross negligence.
